Terms of Use

1 · Agreement#

These Terms of Use are an agreement between you and Propoa Pte. Ltd. ("we", "us"), a company incorporated in Singapore (UEN 202635624D), covering the Auspica apps (Auspica, Auspica Zi Wei and Auspica Qi Men), meet.auspica.app and the Auspica Pro, Zi Wei Pro and Qi Men Pro subscriptions. By downloading, using or subscribing you agree to them. If you don't, please don't use Auspica.

Practitioner Reports are covered by separate Consultant Terms.

2 · Eligibility#

You must be at least 13 years old (16 in the EEA and the UK). If you are under 18, a parent or guardian must agree to these terms for you, and to any purchase. If you are using Auspica on behalf of an organisation, you confirm you may bind it.

3 · What Auspica is#

Auspica produces BaZi charts, Chinese almanac entries and date selections, calculated from published calendar rules and astronomical solar-term times. It is offered for reflection, cultural interest, entertainment and personal planning.

Readings are interpretations of a tradition. Different schools, different settings and different practitioners give different results, and ours are one reasonable reading among several.

Not advice. Auspica does not give medical, legal, financial, psychological or other professional advice. Don't use it to delay or replace professional help. Decisions you make remain your own, and no outcome is promised or guaranteed.

4 · Your account#

An account is optional for the free features. You create one when you subscribe, or when you choose to save and sync your chart. You can sign in with Apple, with Google or with a one-time email link, and there are no passwords. Keep access to your email and devices secure; anyone who has them can reach your account.

5 · Other people's details#

You can add other people's birth details to read their charts. Only add people who are happy for you to. Their birth details are their personal data, and you need their permission. Deleting a person deletes their data.

6 · Subscriptions and payments#

6.1 Plans. Auspica Pro is offered as an annual plan, which starts with a 7-day free trial, or as a monthly plan, which has no trial. The price is shown before you pay, including any tax. Zi Wei Pro, the subscription in the Auspica Zi Wei app, and Qi Men Pro, the subscription in the Auspica Qi Men app, are separate subscriptions, each with its own prices, offered on the same plans and terms as this section describes. Each unlocks only its own app: none of Auspica Pro, Zi Wei Pro and Qi Men Pro unlocks either of the others.

6.2 When you are charged. On the annual plan nothing is charged at checkout. The 7-day free trial starts, the first charge is taken 7 days later when the trial ends, and the same amount is charged once a year after that. On the monthly plan the first charge is taken during checkout, and the same amount is charged once a month after that. Subscriptions renew automatically until cancelled. We give notice before any price change, with the chance to cancel before it takes effect.

6.3 Free trial. The 7-day free trial belongs to the annual plan; the monthly plan does not have one. You are charged when the trial ends unless you cancel at least 24 hours before it ends (App Store) or before it ends (web). One trial per person for each subscription: a trial of Auspica Pro, Zi Wei Pro or Qi Men Pro does not use up either of the other two.

6.4 iPhone app. Purchases in the app are processed by Apple under Apple's terms. Manage or cancel them in Settings → your name → Subscriptions. Refunds for App Store purchases are handled by Apple.

6.5 Website. Purchases on meet.auspica.app are processed by our payment processor, on the same schedule as 6.2: the annual plan takes nothing at checkout and charges on day 7, the monthly plan charges during checkout. You can cancel at any time from your account page; access lasts until the end of the paid period.

6.6 Android. The Android apps have no in-app purchases. Subscribe on the website, then sign in in the app.

6.7 Refunds. See the Refund Policy. Your statutory rights are unaffected, including EU and UK withdrawal rights for digital content.

6.8 One subscription, many devices. Pro works on every device signed in to the same account. If Pro doesn't appear, use Restore Purchases rather than buying again.

6.9 Gifts. On the website you can buy a code for one year of Auspica Pro as a gift, with a single payment processed by our payment processor. It is not a subscription and nothing renews. The code works once, on one account, and never expires; whoever redeems it has Pro for 365 days from redemption, or from the end of the Pro their account already has. Anyone holding the code can redeem it, so keep it safe until you give it; we cannot replace a code someone else has already used. A code cannot be exchanged for cash. Refunds for gifts are in the Refund Policy: an unredeemed code can be refunded within 30 days of purchase, and a redeemed code cannot.

7 · AI features (when available)#

• Answers can be wrong or incomplete, and they are not advice.
• They use your chart data only with your consent, which you can withdraw.
• How much you can ask depends on your plan.
• Don't enter other people's sensitive information.

8 · Acceptable use#

• No scraping, automated access or interfering with security.
• No reverse engineering, except where the law allows it.
• No commercial resale of charts or readings.
• No unlawful use.

9 · Intellectual property#

The app, its readings, designs, calculation engine and the Auspica brand belong to us or our licensors. You get a personal, non-commercial licence to use them while these terms apply. You may share the share cards you generate from your own chart.

10 · Your content#

What you enter is yours. You give us the licence we need to process it in order to run the service for you, and nothing more, for as long as you keep the data with us.

11 · Feedback#

If you send us ideas or suggestions, we may use them to improve Auspica without owing you anything for them. You keep any rights you already had.

12 · Changes and availability#

• Features described as "coming later" are plans, not promises.
• We'll give at least 30 days' notice, in the app or by email, of material changes to paid features.
• We won't remove a paid feature during a period you have already paid for.

13 · Termination#

You can stop using Auspica and delete your account at any time: see Privacy §9. We may suspend or close an account that breaches these terms, and will say why unless the law prevents us.

14 · Disclaimers#

To the extent the law allows, Auspica is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and uninterrupted availability. Some jurisdictions don't allow these exclusions; there, they don't apply to you.

15 · Limitation of liability#

To the extent the law allows, our total liability to you in any 12-month period is limited to the greater of what you paid us in that period and S$100. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

16 · Governing law and disputes#

These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction. Before either of us starts court proceedings, we will set out the issue in writing and give the other 30 days to resolve it, and then try mediation in Singapore. If you are a consumer, you keep the mandatory protections and the courts available to you in your own country.

17 · Apple App Store#

• These terms are between you and us, not Apple.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any warranty, you may notify Apple, and Apple will refund the purchase price; to the extent the law allows, Apple has no other warranty obligation.
• Apple is not responsible for product claims, including product liability, consumer-protection or intellectual-property claims.
• You confirm you are not in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government restricted-party list.
• You must comply with applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

For the iPhone app, these terms are our licence agreement, in place of Apple's standard Licensed Application End User License Agreement.

18 · Google Play#

If you download the Android app from Google Play, Google Play's terms of service apply to that download alongside these terms. The Android app contains no in-app purchases.

19 · General#

These terms, with the Privacy Policy, are the entire agreement between us about Auspica. If a provision is unenforceable, the rest stands. Not enforcing a right once doesn't waive it. You may not assign these terms; we may assign them to a successor. The English version prevails over any translation.
